2006 Official Rules

NO TRANSACTION OR PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A TRANSACTION OR PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

Entry into this Sweepstakes constitutes your acceptance of these Official Rules.

OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA , 18 or older (19 in AL & NE). Void where prohibited by law.

ELIGIBILITY: Sweepstakes is open only to legal residents of the United States, except Puerto Rico, age 18 or older at the time of entry. Officers, directors, employees and agents of Colonial Bank ("Sponsor"), Instant Evaluate ("Administrator"), their affiliated companies and the immediate families of each are not eligible. Sweepstakes governed by U.S. law and subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.

SWEEPSTAKES PERIOD
The first Sweepstakes Entry Period commences at 6:00 a.m. Eastern Time ("ET") on January 1, 2006 and ends on 11:59 p.m. ET on January 31, 2006. There will be twelve (12) monthly sweepstakes, each with an Entry Period beginning at 6:00 a.m. ET on the first day of the month and ending at 11:59 p.m. ET on the last day of the month, and twelve (12) monthly drawings relating thereto. Non-winning monthly drawing entries will not be carried over into subsequent monthly drawings. The final Sweepstakes Entry Period ends on 11:59 p.m. ET on December 31, 2006 (the "sweepstakes Entry Closing Date").

HOW TO ENTER
No transaction or purchase is required to enter. There are three (3) ways to enter the Sweepstakes.
Online: To enter online, visit www.ratecolonial.com (the "Site") and follow the instructions to complete the survey and/or to be entered into the sweepstakes (each an "entry" or "entries"). Online entries will be indexed by email addresses. Only one (1) online entry is allowed per monthly sweepstakes per valid email address. A valid online entry must include a valid email address, name, address, and phone number. If an email address is used for an online entry more that one (1) time in a month, then only the first (1st) entry for the month is a valid entry. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void.

By Phone: To enter by telephone, call toll-free 1-800-431-3562, and follow the instructions. Phone entries will be indexed by the Caller ID number of the phone that was used to take the survey. At the end of a phone survey a caller will be prompted to leave a voice message that includes their name, address and phone number. A maximum of one (1) entry per monthly sweepstakes is allowed per valid Caller ID number. If a Caller ID number is used for a Phone entry more that one (1) time in a month, then only the first (1st) entry of that month is a valid entry. Respondents answering the survey on the Website will be entered into the sweepstakes one (1) time per month. Respondents answering the survey on the Telephone will be entered one (1) time.
By Mail: To enter by mail, hand print (or type) your name, address, day and evening phone numbers, e-mail address (if any), and age on a 3" x 5" piece of paper and mail it in a hand-addressed envelope to Instant Evaluate; 920 East Semoran Boulevard; Casselberry, FL 32707, during the Sweepstakes Period. Mail entries will be included in the monthly drawing according to the date they are received. One entry per hand-addressed outer envelope. Entries that are mailed will be indexed by the address. Photocopied, illegible, or mechanically reproduced entries are not eligible. Sponsor is not responsible for hardware or software failures, lost, unavailable, failed or delayed computer or telephone transmissions or any error which may occur in the receipt or processing of entries. All surveys, entries and information become the property of the Sponsor and will not be returned. Entrants may be contacted by phone or email for promotional purposes. Certain qualified entrants may receive additional invitations to complete surveys for follow-up visits. In the event of a dispute, the entrant will be deemed to be the person whose name was entered in the appropriate area within the survey. Completing a survey, whether online or by telephone, will not increase your chances of winning the Grand Prize.

PRIZE: One (1) Grand Prize will be awarded for each monthly sweepstakes drawing, beginning with the drawing for the January 2006 sweepstakes, which will be held in February 2006. The Grand prize winner for each monthly sweepstakes will receive a gift certificate valued at $100. No substitution for the prize may be made by winner; Sponsor may substitute a prize of equal or greater value in its sole discretion. Taxes associated with the acceptance of the prize are the sole responsibility of the winner. Odds of winning depend upon the number of entries received.

DRAWING: The deadline for all entries is 12:00 am ET on the last day of each month. Mail entries will be included in the monthly drawing according to the date they are received. The winner will be selected 2 weeks after the deadline in a random drawing. The Winner will be notified by mail, email or phone and may be required to complete an Affidavit of Eligibility and Liability/Publicity Release, which must be returned within 14 days of the date on the notification letter or prizes will be forfeited and an alternate winner will be selected. Return of any prize notification letter or prize as undeliverable will result in disqualification and selection of an alternate winner from the entries received during the same sweepstakes period. Entries Odds of winning depend upon the number of eligible entries received, according to the eligibility requirements.

GENERAL: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. No photocopied or mechanically reproduced entries are eligible. Proof of transmission (screenshots or captures of entry etc.) of entry does not constitute proof of delivery. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the sweepstakes.

By participating in the Sweepstakes, you agree (i) to be bound by these official rules, including all eligibility requirements, (ii) to be contacted by email, (iii) to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes, and (iv) that the Sponsor and its agents are not responsible for any liability, loss or damage arising out of or associated with their participation in the sweepstakes or their acceptance, possession, use or misuse of any prize. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online and/or telephone methods of entry if either becomes technically corrupted, (e.g., including if a computer virus or system malfunction inalterably impairs its ability to conduct the sweepstakes), and to select winners from among all entries received including mail-in.

By accepting or participating in a prize, winner consents to the use of their names, addresses, voices, statements relating to the Sweepstakes or Sponsor, and photographs or other likenesses, without further compensation, in any publicity carried out by Sponsor or any related entities in connection with this Sweepstakes, except where prohibited by law. Information submitted in connection with this Sweepstakes will be treated in accordance with Sponsor's privacy policy located at http://www.colonialbank.com. In the event of inadvertent errors in the structure of, or printing of materials used in connection with, this sweepstakes, the Sponsor reserves the right to terminate, suspend or amend this sweepstakes, in whole or in part, without prior notification and with immediate effect. In either of these events, prizes may be awarded based on entries received prior to date of termination or amendment. All federal, state, and local laws and regulations apply.

DISCLAIMERS. Under no circumstances, shall the Sponsor or Administrator be liable for any direct, indirect, incidental, special or consequential damages that result from the access of or inability to access the website, submitting an entry or otherwise participating in any aspect of this Sweepstakes or out of any breach of any warranty. The winner shall bear all risk of loss or damage to his/her prize after it has been delivered. Sponsor and Administrator make no representation or warranties of any kind concerning the appearance, safety or performance of any prize. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability.
